Work Comp FAQ

Workers’ Compensation Common Questions

Frequently Asked Questions about on-the-job injuries

What should I do if I have been injured at work?

It’s critical that you report the injury to your employer right away. Seek the proper medical attention for your injury and begin documenting everything immediately. How you feel, what hurts, what you were told about how you will receive treatment for your injury and by whom. Getting a notebook or setting up a note in your smartphone can help you track key events. Talking to a lawyer early in the process can help you ensure that you are aware of all of your options.

What types of injuries are eligible for workers’ compensation?

When most people think of workers’ compensation, they think about construction workers and other dangerous occupations, and for good reason. There certainly are jobs where workers are much more likely to get injured than others. However, ANY time an injury is sustained at work, a workers’ compensation claim can be filed. So if you work in an office job and then slip and hurt yourself at the office, that would be a potential workers’ comp claim. Nurses who repeatedly lift patients or freight workers who lift repeatedly on the job can pursue compensation for injuries caused by repetitive motion.

Can I be fired for pursuing workers’ compensation?

Strictly speaking, you can NOT be fired for pursing a work comp claim. However, you CAN still be fired for just about anything else, and your employer may be looking for a reason to fire you if you are making a work comp claim. Do not give your employer any excuse to fire you like being late or missing a shift. You may find yourself under much more scrutiny than your co-workers.

What if my Workers’ Comp Claim is Denied?

If you have a claim, any treatment, or payment for treatment you have received denied for any reason, call an attorney immediately. Unfortunately, there are cases where legitimate claims are denied. Having an experienced lawyer on your side ensures that your rights are protected and that you receive the treatment, and compensation that you deserve.
